Immigrants’ Rights Organizations Head to Court to Defend Unaccompanied Children

LOS ANGELES – Immigrant rights organizations are heading to a California federal district court on Tuesday, November 7th, for trial in Immigrant Defenders Law Center v. Department of Homeland Security. The case challenges the Biden Administration’s practice of denying unaccompanied children previously subjected to the Migrant Protection Protocols program (MPP, also known as Remain in Mexico) their congressionally mandated protections under the Trafficking Victims Protection Reauthorization Act (TVPRA). The federal government seeks to continue this dangerous and harmful practice in violation of the TVPRA while skirting both transparency and accountability.

As a result of attempts by the federal government to deny plaintiffs their day in court, the trial comes more than two-and-a-half years after the initial filing of the lawsuit. Plaintiffs’ witnesses will deliver compelling testimony to ensure that the government is held to account for its unconscionable actions toward unaccompanied youth. 

Plaintiff organizations include Immigrant Defenders Law Center (ImmDef), RAICES, and the ABA’s South Texas Pro Bono Asylum Representation Project (ProBAR), who seek to ensure that vulnerable children are given the protections guaranteed to them by Congress. 

The plaintiffs are represented by the ImmDef, Justice Action Center, and Simpson Thacher and Barlett LLP.
